[ Return to Contents | Post a Reply | Post a new message ] Moose out of season court result Posted by foodog2 on Nov 19 2005 Today was my day in court for shooting a spike bull out of season by accident. I knew it was bad and that I would have to pay a fine. I sat there while several people were arraigned for various things DUI, drug possession, domestic violence... These were all Class B and A misdemeanors and these folks were all or most repeat offenders. The largest fine I saw was $300. I received a $2,500 fine, probation for a year, and was told that the court needed to send a message. The DA insisted on taking my liscense, but the judge said it was already a phenominal fine and I would think twice before shooting again. The judge even went as far as to agree it was a mistake. The problem was that if I had not seen the trooper in the field they questioned if I would have turned myself in. There is no winning a he said she said against a cop in court and I walk out with my pride. I will still sleep well at night knowing I did what my conscience demanded of me. However, there is a problem with the system that the penalty for possession of 1/2 pound of marijuana, or driving without a license for the third time because it was suspended for DUI is less than a hunting violation where I turned myself in. That tells me and the people in the court there is less penalty to do and deal drugs and flagrantly ignore the law then have integrity and do the right thing.
