I have no problem with the scenario you illustrated, because the hunter wasn't using the airplane for spotting then shooting game; a practice to which I strongly object. Well... I object to labeling such practices as "sport hunting". Subsistence, sure. But it's not sport hunting. Of course, the problem with the situation you described is that some hunters WILL use the aircraft for aerial spotting and then you're back to a "land-and-shoot" situation. This is the problem with legislating morality. The guys who won't cross the line anyway just find themselves saddled with restrictions that may not apply, and the guys looking for loopholes will find and exploit them. You can't make laws to cover all the possibilities.
That said, I certainly respect a person's right to have a different view, though in this case I think it's a bad idea to allow same-day airborne. We have to put SOME restrictions on ourselves (in my opinion).
